Does a person who is receiving Social Security Disability and/or Medicare, but not Medicaid, need a Special Needs Trust?

It depends. A review of the person's prognosis and future needs must be undertaken. An analysis of the public benefits that may be available to pay for those medical expenses must also be completed. If there are future medical needs that are not covered by Medicare or private insurance, but are covered by Medicaid, a Special Needs Trust may be needed to protect future public benefit eligibility.
